Report + Support Privacy Notice
Teach First is a registered charity (number 1098294) in England and Wales. This privacy notice is designed to help you understand how we will process any personal data that we collect about you when utilising the Report and Support tool.
Report and Support is a tool which enables programme members and employees to tell Teach First about an equality, diversity and inclusion incident that has happened to them during their time at Teach First. These are incidents which relate to a protected characteristic, including but not limited to incidents such as harassment, sexual misconduct, hate crime and microaggressions. Further information about how this information is used is below.
The information we collect about you
You can choose to make either a Named Report or an Anonymous Report. The information that is collected about you will differ according to the report type.
Named Report
- Names and contact details
- Information about the programme you are on (if you are a programme member)
- Information about the Directorate you belong to (if you are an employee)
- Information about the incident, including where the incident took place, how long it has been going on for and any other details that you may provide in the free text box.
- Special category personal data that you would like to share with Teach First, such as information about your race/ethnicity, religious beliefs, sexual orientation etc (this is an optional question that can be skipped)
Anonymous Report
If an anonymous report is made, Teach First is not able to know who has submitted this.
- Information about the incident, including where the incident tool place, how long it has been going on for, what protected characteristics may have been involved, and any other details that you may provide in the free text box.
- Information about what programme you are on (if you are a programme member)
- Information about what Directorate you belong to (if you are an employee)
- Information about why you have chosen to report anonymously.
- Special category personal data that you would like to share with Teach First, such as information about race/ethnicity, religious beliefs, sexual orientation (this is an optional question that can be skipped).
How your data is used
Depending on the report type, Teach First uses your data to:
Named Report
- Contact you to discuss the incident
- Manage your report to resolution and develop a plan of action with you.
- Signpost you to internal and external support services.
- Monitor themes and trends to result in proactive and preventative work.
Anonymous Report
- As anonymous reports cannot be followed up with the individual, this data will be used to assess trends and themes to result in proactive and preventative work.
Our data processing status
Teach First is the data controller for any data you submit into the system. Culture Shift will be acting as our Data Processor.
Legal Basis for Processing
Teach First will always handle all personal and Special Category data in accordance with the UK Data Protection Act 2018. All data processed as part of a report you submit will be done so under one of the following legal bases;
- Where there is a contractual relationship with you
- Where we are legally obliged to process your data
- Where we believe it is in the public interest to process your data and this interest is supported by clear law e.g. safeguarding
Disclosure of personal data
Teach First is committed to handling your report sensitively and respectfully. Your personal data will not be shared with anyone external to Teach First unless there is an overwhelming legitimate reason to do so. Only designated individuals will be given strict need-to-know access to your data. For Programme Members, this will usually be your Development Lead or Achievement Partner. For employees, this will usually be a HR Business Partner. In the case that the alleged perpetrator is one of these individuals, an alternative staff member will be found to manage the case.
However, there are exceptions where we cannot maintain confidentiality and the contents of your report must be escalated to other individuals internal and external to Tech First – even if you do not consent. The following circumstances would require escalation. Please note that this list is not exhaustive:
- A child safeguarding incident
- That you are risk of harm
- That others, including pupils or other programme members, are at risk of harm.
- Any incident that Teach First considers to be a serious incident.
Retention
Identifiable information submitted as part of a report will be retained by Teach First for 6 years, after which time it will be deleted from the system.
Your rights
The following rights may be applicable to you in relation to data you have shared with us via a report:
- The right to request that any inaccurate information Teach First holds about you is rectified.
- The right to have any information Teach First holds about you to be erased where there is no good reason for us to continuing to process it.
- The right to restrict the processing of the information Teach First holds about you in certain circumstances.
- The right of access and the right to obtain copies of the personal data that we hold about you, and other supplementary information, under data protection law.
- The right to receive copies of any information Teach First hold about you in a structured, commonly used and machine-readable format. You also have the right to request that we transmit the information that we hold about you to another data controller.
- The right to object to our use of your personal data for direct marketing purposes at any time and you may have the right to object to our processing of some or all of your personal data (and require them to be deleted) where we are relying on a legitimate interest and there is something about your circumstances which makes you want to object to processing on this ground as you feel it impacts your fundamental rights.
- Withdraw consent if applicable
- To lodge a complaint with the ICO
